New Anti-Smoking Law in Spain

Spain is taking significant steps to combat smoking with new legal reforms. The Ministry of Health is accelerating efforts to have these reforms approved or substantially advanced by the end of the year. These changes aim to expand smoke-free public spaces and tighten restrictions on the sale and advertising of electronic cigarettes.


The Push for Reform

The Ministry of Health, led by Mónica García, initiated a draft law to reform regulations on the sale, supply, consumption, and advertising of tobacco for the first time in over a decade. This draft law is open for public consultation until August 15, after which it will be refined and sent to the Council of Ministers for approval.

Key Reforms

Generic Packaging and Flavor Ban

In April, the Ministry took the first step by approving a decree to implement generic packaging and ban flavorings in cigarettes and vapes. This move aims to reduce the appeal of these products, especially among young people.

Expanding Smoke-Free Public Spaces

The new draft law focuses on increasing smoke-free public spaces. While specific areas are not yet detailed, the ministry is targeting restaurant and bar terraces, bus and tram shelters, and community spaces like beaches. This measure is supported by two-thirds of citizens and the medical profession, who emphasize the dangers of passive smoking, which causes serious illnesses in non-smokers.

Restricting Electronic Cigarettes

The law also aims to restrict the sale and consumption of electronic cigarettes, particularly among young people. Advertising and promotion of these products will face similar restrictions to those applied to traditional tobacco products. This includes limiting endorsements by influencers and at youth-oriented events.

The Need for Change

Reducing Passive Smoking

Passive smoking remains a major health concern, causing diseases and deaths among non-smokers. Many non-smokers are exposed to harmful smoke in public spaces like terraces, leisure areas, homes, and near schools and workplaces. The new reforms aim to protect these vulnerable groups by reducing unwanted exposure to tobacco smoke and vapors.

Addressing New Tobacco Products

The existing regulations, enacted nearly 15 years ago, are now outdated. They do not adequately address the rise in new tobacco products, such as electronic cigarettes and herbal smoking products. The draft law seeks to close these gaps by extending current restrictions to these newer products, regardless of whether they contain nicotine.

Moving Forward

Public Consultation

Citizens, associations, and NGOs have until August 15 to submit proposals and feedback on the draft law. This process allows for community input and ensures that the reforms address public concerns and needs effectively.

Finalizing the Law

Following the consultation period, the draft law will be revised and prepared for submission to the Council of Ministers. While some measures, such as increased taxes on tobacco, were postponed due to opposition from the Ministry of Finance, they may still be implemented in the future


Spain is making a bold move to tighten smoking regulations and protect public health. The proposed reforms aim to create more smoke-free spaces and control the spread of new tobacco products. It would be great if these laws are brought in, but they need to be enforced.. The amount of cigarette butt’s on the beach is disgraceful.. 😢
